ט וַיְדַבֵּר יְדוָד אֶל מֹשֶׁה לֵּאמֹר׃

י דַּבֵּר אֶל בְּנֵי יִשְׂרָאֵל וְאָמַרְתָּ אֲלֵהֶם כִּי אַתֶּם עֹבְרִים אֶת הַיַּרְדֵּן אַרְצָה כְּנָעַן׃
10 Daber el bnei Yisra'el ve'amarta alehem ki atem ovrim et haYarden artzah Kena'an
יא וְהִקְרִיתֶם לָכֶם עָרִים עָרֵי מִקְלָט תִּהְיֶינָה לָכֶם וְנָס שָׁמָּה רֹצֵחַ מַכֵּה נֶפֶשׁ בִּשְׁגָגָה׃
11 Vehikritem lachem arim arei miklat tihyenah lachem venas shamah rotze'ach makeh nefesh bishgagah
יב וְהָיוּ לָכֶם הֶעָרִים לְמִקְלָט מִגֹּאֵל וְלֹא יָמוּת הָרֹצֵחַ עַד עָמְדוֹ לִפְנֵי הָעֵדָה לַמִּשְׁפָּט׃
12 Vehayu lachem he'arim lemiklat migo'el velo yamut harotze'ach ad omdo lifnei ha'edah lamishpat
יג וְהֶעָרִים אֲשֶׁר תִּתֵּנוּ שֵׁשׁ עָרֵי מִקְלָט תִּהְיֶינָה לָכֶם׃
13 Vehe'arim asher titenu shesh arei miklat tihyenah lachem
יד אֵת שְׁלֹשׁ הֶעָרִים תִּתְּנוּ מֵעֵבֶר לַיַּרְדֵּן וְאֵת שְׁלֹשׁ הֶעָרִים תִּתְּנוּ בְּאֶרֶץ כְּנָעַן עָרֵי מִקְלָט תִּהְיֶינָה׃
14 Et shalosh he'arim titnu me'ever laYarden ve'et shalosh he'arim titnu be'eretz Kena'an arei miklat tihyenah
טו לִבְנֵי יִשְׂרָאֵל וְלַגֵּר וְלַתּוֹשָׁב בְּתוֹכָם תִּהְיֶינָה שֵׁשׁ הֶעָרִים הָאֵלֶּה לְמִקְלָט לָנוּס שָׁמָּה כָּל מַכֵּה נֶפֶשׁ בִּשְׁגָגָה׃
15 Livnei Yisra'el velager velatoshav betocham tihyenah shesh he'arim ha'eleh lemiklat lanus shamah kol makeh nefesh bishgagah
טז וְאִם בִּכְלִי בַרְזֶל הִכָּהוּ וַיָּמֹת רֹצֵחַ הוּא מוֹת יוּמַת הָרֹצֵחַ׃
16 Ve'im bichli varzel hikahu vayamot rotze'ach hu mot yumat harotze'ach
יז וְאִם בְּאֶבֶן יָד אֲשֶׁר יָמוּת בָּהּ הִכָּהוּ וַיָּמֹת רֹצֵחַ הוּא מוֹת יוּמַת הָרֹצֵחַ׃
17 Ve'im be'even yad asher yamut bah hikahu vayamot rotze'ach hu mot yumat harotze'ach
יח אוֹ בִּכְלִי עֵץ יָד אֲשֶׁר יָמוּת בּוֹ הִכָּהוּ וַיָּמֹת רֹצֵחַ הוּא מוֹת יוּמַת הָרֹצֵחַ׃
18 O bichli etz yad asher yamut bo hikahu vayamot rotze'ach hu mot yumat harotze'ach
יט גֹּאֵל הַדָּם הוּא יָמִית אֶת הָרֹצֵחַ בְּפִגְעוֹ בוֹ הוּא יְמִיתֶנּוּ׃
19 Go'el hadam hu yamit et harotze'ach befig'o vo hu yemitenu
כ וְאִם בְּשִׂנְאָה יֶהְדָּפֶנּוּ אוֹ הִשְׁלִיךְ עָלָיו בִּצְדִיָּה וַיָּמֹת׃
20 Ve'im besin'ah yehdafenu o hishlich alav bitzdiyah vayamot
כא אוֹ בְאֵיבָה הִכָּהוּ בְיָדוֹ וַיָּמֹת מוֹת יוּמַת הַמַּכֶּה רֹצֵחַ הוּא גֹּאֵל הַדָּם יָמִית אֶת הָרֹצֵחַ בְּפִגְעוֹ בוֹ׃
21 O ve'eivah hikahu veyado vayamot mot yumat hamakeh rotze'ach hu go'el hadam yamit et harotze'ach befig'o vo
כב וְאִם בְּפֶתַע בְּלֹא אֵיבָה הֲדָפוֹ אוֹ הִשְׁלִיךְ עָלָיו כָּל כְּלִי בְּלֹא צְדִיָּה׃
22 Ve'im befeta belo eivah hadafo o hishlich alav kol kli belo tzediyah
כג אוֹ בְכָל אֶבֶן אֲשֶׁר יָמוּת בָּהּ בְּלֹא רְאוֹת וַיַּפֵּל עָלָיו וַיָּמֹת וְהוּא לֹא אוֹיֵב לוֹ וְלֹא מְבַקֵּשׁ רָעָתוֹ׃
23 O vechol even asher yamut bah belo re'ot vayapel alav vayamot vehu lo oyev lo velo mevakesh ra'ato
כד וְשָׁפְטוּ הָעֵדָה בֵּין הַמַּכֶּה וּבֵין גֹּאֵל הַדָּם עַל הַמִּשְׁפָּטִים הָאֵלֶּה׃
24 Veshaftu ha'edah bein hamakeh uvein go'el hadam al hamishpatim ha'eleh
כה וְהִצִּילוּ הָעֵדָה אֶת הָרֹצֵחַ מִיַּד גֹּאֵל הַדָּם וְהֵשִׁיבוּ אֹתוֹ הָעֵדָה אֶל עִיר מִקְלָטוֹ אֲשֶׁר נָס שָׁמָּה וְיָשַׁב בָּהּ עַד מוֹת הַכֹּהֵן הַגָּדֹל אֲשֶׁר מָשַׁח אֹתוֹ בְּשֶׁמֶן הַקֹּדֶשׁ׃
25 Vehitzilu ha'edah et harotze'ach miyad go'el hadam veheshivu oto ha'edah el ir miklato asher nas shamah veyashav bah ad mot hakohen hagadol asher mashach oto beshemen hakodesh
כו וְאִם יָצֹא יֵצֵא הָרֹצֵחַ אֶת גְּבוּל עִיר מִקְלָטוֹ אֲשֶׁר יָנוּס שָׁמָּה׃
26 Ve'im yatzo yetze harotze'ach et gvul ir miklato asher yanus shamah
כז וּמָצָא אֹתוֹ גֹּאֵל הַדָּם מִחוּץ לִגְבוּל עִיר מִקְלָטוֹ וְרָצַח גֹּאֵל הַדָּם אֶת הָרֹצֵחַ אֵין לוֹ דָּם׃
27 Umatza oto go'el hadam michutz ligvul ir miklato veratzach go'el hadam et harotze'ach ein lo dam
כח כִּי בְעִיר מִקְלָטוֹ יֵשֵׁב עַד מוֹת הַכֹּהֵן הַגָּדֹל וְאַחֲרֵי מוֹת הַכֹּהֵן הַגָּדֹל יָשׁוּב הָרֹצֵחַ אֶל אֶרֶץ אֲחֻזָּתוֹ׃
28 Ki ve'ir miklato yeshev ad mot hakohen hagadol ve'acharei mot hakohen hagadol yashuv harotze'ach el eretz achuzato
כט וְהָיוּ אֵלֶּה לָכֶם לְחֻקַּת מִשְׁפָּט לְדֹרֹתֵיכֶם בְּכֹל מוֹשְׁבֹתֵיכֶם׃
29 Vehayu eleh lachem lechukat mishpat ledoroteichem bechol moshvoteichem
ל כָּל מַכֵּה נֶפֶשׁ לְפִי עֵדִים יִרְצַח אֶת הָרֹצֵחַ וְעֵד אֶחָד לֹא יַעֲנֶה בְנֶפֶשׁ לָמוּת׃
30 Kol makeh nefesh lefi edim yirtzach et harotze'ach ve'ed echad lo ya'aneh venefesh lamut
לא וְלֹא תִקְחוּ כֹפֶר לְנֶפֶשׁ רֹצֵחַ אֲשֶׁר הוּא רָשָׁע לָמוּת כִּי מוֹת יוּמָת׃
31 Velo tikchu chofer lenefesh rotze'ach asher hu rasha lamut ki mot yumat
לב וְלֹא תִקְחוּ כֹפֶר לָנוּס אֶל עִיר מִקְלָטוֹ לָשׁוּב לָשֶׁבֶת בָּאָרֶץ עַד מוֹת הַכֹּהֵן׃
32 Velo tikchu chofer lanus el ir miklato lashuv lashevet ba'aretz ad mot hakohen
לג וְלֹא תַחֲנִיפוּ אֶת הָאָרֶץ אֲשֶׁר אַתֶּם בָּהּ כִּי הַדָּם הוּא יַחֲנִיף אֶת הָאָרֶץ וְלָאָרֶץ לֹא יְכֻפַּר לַדָּם אֲשֶׁר שֻׁפַּךְ בָּהּ כִּי אִם בְּדַם שֹׁפְכוֹ׃
33 Velo tachanifu et ha'aretz asher atem bah ki hadam hu yachanif et ha'aretz vela'aretz lo yechupar ladam asher shupach bah ki im bedam shofcho
לד וְלֹא תְטַמֵּא אֶת הָאָרֶץ אֲשֶׁר אַתֶּם יֹשְׁבִים בָּהּ אֲשֶׁר אֲנִי שֹׁכֵן בְּתוֹכָהּ כִּי אֲנִי יְדוָד שֹׁכֵן בְּתוֹךְ בְּנֵי יִשְׂרָאֵל׃

Sometimes the great story of a people is revealed precisely through a small detail in the law.

In the sixth aliyah of Parashat Masei we continue to deal with the cities of refuge, but now the view widens. The Torah commands the establishment of six cities of refuge: three east of the Jordan and three in the land of Canaan itself. Their purpose is one, to allow refuge for one who kills unintentionally, until he stands trial.

But this is not merely a legal system of shelters. In the same breath the Torah describes here all the laws concerning the intentional murderer, whose sentence is death, and also the distinction between cases of prior hatred and an unintended mishap. In addition, the Torah warns: “velo tachanifu et ha’aretz” (you shall not defile the land, Numbers 35:33). Blood that is spilled, even without intent, defiles the land, requires a public response, demands repair.

This distinction between error and malice, between crime and failure, is a very deep principle of justice. The Torah is not satisfied with good intentions, but neither does it punish at any cost. There is a human, moral, legal sensitivity here.

What is striking is that the refuge is not free. The unintentional killer does not go free; he is sent to dwell in a city of refuge until the death of the High Priest. This connects a person’s individual judgment with the general spiritual state of the nation. When the High Priest dies, a new period opens, and the person may return to his inheritance.

The message is sharp: the Torah offers an anchor of precise and courageous distinction, and at the same time a human one. There are failures that cannot be resolved at once, and there is repair that comes only with time.
